Terms of Service

Welcome to Bisayaflix! These Terms of Service (“Terms”) govern your use of our mobile application located at https://bisayaflix.com (the “App”) and any related services provided by Bisayaflix (“we,” “us,” or “our”). By accessing or using the mobile app, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By accessing or using the App, you agree to comply with and be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

2. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. Account Registration

To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

4. Subscription and Billing

Bisayaflix offers subscription plans for accessing content on the App. By subscribing, you agree to pay the applicable subscription fees and any taxes. Subscription fees are non-refundable except as expressly set forth in these Terms.

4.1 Automatic Renewal

Your subscription will automatically renew at the end of each subscription period unless you cancel your subscription before the renewal date. You authorize us to charge your payment method for the renewal.

4.2 Cancellation

You may cancel your subscription at any time through your account settings. Your cancellation will take effect at the end of the current billing period, and you will not receive a refund for any unused portion of the subscription period.

5. Use of the Mobile App

5.1 License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the App for personal, non-commercial purposes.

5.2 Prohibited Conduct

You agree not to:

    • Violate any laws, regulations, or third-party rights.
    • Post, upload, or distribute any content that is unlawful, infringing, defamatory, or otherwise objectionable.
    • Interfere with or disrupt the App or servers or networks connected to the App.
    • Use any data mining, robots, or similar data gathering and extraction tools.

6. Content

6.1 User Content

You may submit content to the App, including reviews and comments (“User Content”). You retain ownership of your User Content, but you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your User Content in connection with the App.

6.2 Our Content

All content on the App, including text, graphics, images, and software, is the property of Bisayaflix or its licensors and is protected by copyright and other intellectual property laws. You may not use, reproduce, or distribute any content without our prior written permission.

7. Termination

We may terminate or suspend your access to the App at any time, with or without cause or notice, for conduct that we believe violates these Terms or is harmful to other users of the App, us, or third parties.

8. Disclaimers and Limitation of Liability

8.1 Disclaimers

The App is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted or error-free.

8.2 Limitation of Liability

To the maximum extent permitted by law, Bisayaflix will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use of or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; and (iii) any other matter relating to the App.

9. Indemnification

You agree to indemnify and hold Bisayaflix, its affiliates, officers, agents, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the App, your violation of these Terms, or your violation of any rights of another.

10. Governing Law

These Terms and any dispute arising out of or related to these Terms or the App will be governed by and construed in accordance with the laws of Philippines, without regard to its conflict of law principles.

11. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on the App and updating the “Effective Date” above. Your continued use of the App after the changes take effect constitutes your acceptance of the updated Terms.
